Returns & Exchanges Policy
This Returns and Exchanges Policy applies to all purchases made through the website PacoRogiene.com, the Paco Rogiene mobile applications, and any other website or application that directs you to this Returns and Exchanges Policy (collectively, the "Site").
All Paco Rogiene online purchases made through the Site are valid for exchange, credit, or refund within 30 days from the ship date with the exception of any “One of a Kind” items and any custom made items. Your return form and invoice provide a postmark date that specifies the last day you have to return your merchandise by mail.
Items must be returned unwashed, unworn, undamaged, and with all tags attached. Jewelry must be in its original packaging. All returned items must be accompanied by the return form and customs documents (if applicable).
SALE MERCHANDISE, UNDERWEAR, SELECT LINGERIE AND SWIMWEAR, EARRINGS, AND GIFT CARDS / E-GIFT CARDS ARE ALL FINAL SALE ITEMS AND CANNOT BE RETURNED OR EXCHANGED, UNLESS REQUIRED BY LAW.

Returns By Mail
Your package includes an order invoice, return form, customs documents (if applicable), and a pre-printed merchandise return label.
- On your return form, check off the items you wish to return and list the return reason code(s).
- Securely pack your merchandise and return form in a box or envelope of your choice (you may also use the original package if possible).
- Place the pre-printed return label on the outside of your package. Please note that the return label is not pre-paid, therefore, you will be responsible for the return shipping cost.In addition, any shipping charge paid by you is non-refundable unless you received damaged, defective, or the wrong item(s).

Refunds will be issued in the original form of payment. Please allow 2-3 weeks from the return ship date for your account to be credited, and 1-2 billing cycles for the credit to appear on your statement. For returns from international and APO/FPO addresses, please allow 4-6 weeks from the return ship date for your account to be credited, and 2-3 billing cycles for the credit to appear on your statement. If you made your purchase using a gift card, e-gift card, or store credit, refunds will be issued to the original card that was used. The refund amount will include only the amount paid by you after any discount or reward was applied to the returned item(s) and it will not include any shipping charge paid by you unless you are returning a damaged, defective, or the wrong item was sent to you.
Damaged, defective, or wrong item(s)
BY MAIL: Exchanges by mail are only processed for damaged, defective, or the wrong item(s) shipped.
Should you receive damaged, defective, or the wrong item(s), please return the merchandise to our Online Returns address above within 30 days from the ship date. The refund amount will include the amount paid by you after any discount or reward was applied to the returned item(s) plus any original shipping charge paid by you and the return shipping costs ONLY if a copy of the shipping receipt is attached to the return form. We recommend using a carrier service that provides tracking. Please note: only standard carrier services will be refunded.
To ensure proper processing, please select the appropriate Return Reason Code listed on your return form. In addition, please specify the damage, defect, or wrong item(s) on the return form. Upon receipt of your return, our Online Returns Department will inspect your merchandise to confirm that the item is damaged, defective and/or the wrong item. If you would like a replacement of the item(s), please write Exchange on the return form in the notes section. We will gladly send out a replacement of the original item(s) purchased, at no cost, as long as the merchandise is available. If the merchandise is not available for an exchange, you will receive a refund to the original form of payment used to make your online purchase.
Returns for online purchases made with gift cards / e-certificates
Refunds can only be made to the exact gift card or e-gift Certificate used for the original purchase. Please retain the gift card and/or e-gift certificate after your online purchase, for return refunds and future purchases.

Governing law & Venus
For any action at law or in equity relating to the arbitration provision of this Returns and Exchanges Policy, the Excluded Disputes or if you opt out of the agreement to arbitrate, you agree to resolve any dispute you have with Paco Rogiene exclusively in a state or federal court located in New York, New York, and to submit to the personal jurisdiction of the courts located in New Yorks County for the purpose of litigating all such disputes.
If any provision of these Returns and Exchanges Policy is held to be unlawful, void, or for any reason unenforceable during arbitration or by a court of competent jurisdiction, then that provision will be deemed severable from this Returns and Exchanges Policy and will not affect the validity and enforceability of any remaining provisions. Paco Rogiene's failure to insist upon or enforce strict performance of any provision of this Returns and Exchanges Policy will not be construed as a waiver of any provision or right. No waiver of any of this Returns and Exchanges Policy will be deemed a further or continuing waiver of such term or condition or any other term or condition. WHERE DO WE SHIP?
We deliver within the continental US, US Territories, Alaska and Hawaii. We also deliver to APO/FPO/DPO addresses.
Certain products have transportation restrictions, and cannot be shipped to some locations.
HOW LONG DOES STANDARD DELIVERY TAKE?
Standard orders should be delivered within 7 to 10 business days following order confirmation. Please allow up to 2 additional days for rural zip codes.
Shipping is available within the US. We also ship standard orders to US Territories, Alaska, Hawaii and APO/FPO/DPO addresses, which requires additional time for delivery and may be subject to delivery restrictions based on the item type, weight and size.
During high season and sale, delivery might take a little longer.
If we are unable to process your order due to inaccurate or incomplete payment information, your order processing may be delayed an additional 2 business days. Orders with out of stock item(s) may take an additional 5 business days to process and ship.

Next Day Delivery is not available for Alaska, Hawaii, US Territories, APO/FPO/DPO addresses and P.O. boxes at this time.

Credit Card Fraud
PLEASE READ CAREFULLY
At PacoRogiene NYC,LLC we do not tolerate credit card fraud. No expense will be spared and all fraud without exception will be prosecuted to the full extent of the law. In addition, we will pursue civil legal action seeking any loss of income related to the fraud, including business, legal fees, research costs, employee down time and loss of revenues.
PacoRogiene NYC,LLC also considers credit card charge backs or Google Checkout disputes to be fraud if you made no reasonable effort to notify us that a problem existed and allow us considerable time to resolve or clarify the or matter.
All frivolous charge backs not only costs our employees time away from our usual and customary matters of conducting normal business, but costs us money, therefore:
YOU AGREE that if you choose to do business with PacoRogiene NYC,LLC and file a dispute/claim or charge back with your credit card company for a situation that contradicts our terms & conditions which you agree to when placing your order OR have not allotted us sufficient time to acknowledge, confirm, and research the situation; and as of any result, you do not win the charge back argument or dispute/claim you agree to pay us $150.00 for our time responding to the matter. You authorize us to charge this amount to your credit card. If this charge is rejected, PacoRogiene NYC,LLC will peruse legal action to recoup losses for our time associated with responding to the charge back and or dispute/claim in addition to any other fees explained below.
In the event that you win the charge back with your credit card company, and have not returned our certificate or have submitted it to the Court, PacoRogiene NYC,LLC will attempt to recover fraudulently disputed charges plus additional costs via a third-party collection agency and your account will be reported to all credit bureaus as a delinquent collection account. This may severely damage your credit rating for at least the next seven (7) years. At this point, we will no longer accept a return of the certificate as settlement for the debt and will only accept payment in full.
Note: The customer must return the certificate obtained, and must not have use it or filed it with a Court, before attempting a chargeback.
CEASE AND DESIST
Client understands and is hereby notified that once a chargeback, dispute/claim or legal action is taken; all communication where it be via email, telephone, internet, or U.S. mail with PacoRogiene NYC,LLC will cease and desist.
RIGHT TO REFUSE A CLIENT
As a side note, management reserves the right to cancel an order and/or issue a refund, and pursue legal action against any customer who is deemed hostile. Hostile customers are those who initiate charge backs or dispute/claims without valid cause (particularly after the receipt of certificate), threaten/harass staff members in person, over the phone, internet, or email, and those who attempt to slander and/or commits acts of libel against PacoRogiene NYC,LLC. and all divisions there under.
We are not interested in legal battles, but we are prepared to take them on when necessary.
LEGAL: You agree via your conducting business with PacoRogiene NYC,LLC that any legal action resulting from any transaction will be guided by the laws of and take place in the PacoRogiene NYC,LLC home state of Texas. You agree to reimburse us or any representative we may appoint for any legal expenses your actions may make us incur. We take fraud seriously. If any provision of this Agreement is deemed illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. The waiver of a breach hereunder does not waive any other or subsequent breach.
PLEASE NOTE OUR POLICY ON CHARGEBACK
• Customer understands that Company does not tolerate fraudulent charge backs or frivolous disputes/claims and will proceed to collect by any means necessary.
• Customer is responsible for charge back fees consisting of attorney's fees, fees for collection agencies or third party intervention if client fraudulently charges back or does not pay monies owed.
• If Customer charges back fraudulently, client will owe charge back fees plus amount owed.
• Company will report any outstanding balances to the three major credit bureaus (Equifax, Experian, Trans Union.) as a delinquent collection account.
• Company will have the incident reported to anti-fraud databases, which will attempt to prevent any further purchases on the Internet.
Stolen Credit Card Purchases
We log IP strings on all orders - any orders coming back as a chargeback due to fraudulent activities will be diligently pursued through your local jurisdiction for prosecution to the fullest extent of the law.
